Privacy Notice for U.S. Consumers

This Privacy Policy (“Policy”) describes how myPOS LLC, doing business as myPOS, protects and manages Your personal data, including:

  • What data we collect when You sign-up for, use, or engage with any of our applications, products, services, or websites (collectively, the "Services");
  • How we manage data from the beginning of Your engagement onwards;
  • The choices You have regarding how Your data is managed.

This Policy applies to information we collect in connection with Your access and use of our Services. Please read this Policy carefully. By continuing to use or access our Services, You are consenting to the practices described in this Policy.

myPOS LLC. (“myPOS”) operates the myPOS software platform. It is myPOS’s policy to maintain the confidentiality, integrity, and security of any personal information about its users.

This Privacy & Security Policy (“Policy”) explains how myPOS (“We”, “Us”, or “Our”) collects, uses, shares, and keeps secure Your information (“You”, “You”, “Your”, or “User”), including Your nonpublic personal information, when You use myPOS’s website myPOS.com (the “Website”), mobile application (the “App”), and any related products and services (collectively referred to as the “Services”).

By using Our Services, You are agreeing to this Policy. If You do not agree to these terms, You may not enroll in or use the Services. Pursuant to this Policy, You direct Our partner financial institution(s) to share Your transactional data with myPOS, and You direct myPOS to share Your data with its users, vendors, partners, and affiliates at its discretion, in a way that would otherwise be contrary to this Policy.

1. Website Visitors

Like most website operators, myPOS collects non-personally identifying information that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. myPOS’s purpose in collecting non-personally identifying information is to better understand how myPOS’s visitors use its website. From time to time, myPOS may release non-personally identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

myPOS also collects potentially personally identifying information like Internet Protocol (IP) addresses for logged in Users and for Users leaving comments on blogs. myPOS only discloses logged in User and commenter IP addresses under the same circumstances that it uses and discloses personally identifying information as described below, except that blog commenter IP addresses and email addresses are visible and disclosed to the administrators of the blog where the comment was left.

myPOS collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with myPOS. myPOS does not disclose personally identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain Services.

2. Customers of myPOS

GATHERING OF PERSONALLY IDENTIFYING INFORMATION

The amount and type of information that myPOS gathers depends on the nature of the interaction. Certain visitors to myPOS’s websites choose to interact with myPOS in ways that require myPOS to gather personally identifying information, most notably when becoming a “Customer” (which means that You have registered with myPOS to use its App or related products or services). Registration involves provision of an email address, a password, and a PIN (collectively the “Registration Information”).

To help the government fight the funding of terrorism and money laundering activities, the USA PATRIOT Act, a Federal law, requires financial institutions to obtain, verify, and record information that identifies each business that opens an account and the personal information of its owners or representatives. Therefore, when applying to become a Customer, myPOS, on behalf of its partner financial institution, will collect personally identifying information about You personally and about Your business to establish and maintain Your account. Personal information may include, but is not limited to, Your name, personal address (residential address required, no PO box address allowed), date of birth, social security number (SSN), and other similar information. Business information may include, but is not limited to, Your business name, tax identification number, business address, business telephone number, business bank account information, business related documentation, telephone number, and email address. Additional information will be requested at account opening and may be requested throughout the life of the account relationship to meet regulatory and legal requirements. If You choose to provide us with personal information, business information, financial information, and financial data, You consent to the transfer and storage of that information on our servers located within the United States.

USE OF PERSONALLY IDENTIFYING INFORMATION

myPOS and its affiliated companies use and disclose User’s personal information to provide the Services, as well as for the purposes of:

  • Analyzing site usage and improve the Service;
  • Delivering to You any administrative notices, alerts and communications relevant to Your use of the Service;
  • Marketing Our products and services and those of our business partners that We believe may be of interest to You;
  • Fulfilling Your requests for certain products and services;
  • Market research, project planning, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity;
  • Third-party vendors providing services to myPOS which are bound by these same privacy restrictions;
  • Enforcing Our Terms of Use; and
  • As otherwise set forth in this Privacy and Security Policy (including disclosures to protect our rights, if required by law, or relating to a transfer of control or sale of assets, as discussed below).

3. Additional Information for U.S. Consumers

Do Not Track and Google Analytics

Some internet browsers have “Do Not Track” or “DNT” features, which, when turned on, send a signal to the website that the individual visiting the website does not wish to be tracked. Our website does not honor DNT signals, but You can set Your browser settings to restrict the placement of cookies (see our Cookies Policy here). However, please be aware that other parties may be conducting online tracking on our website. Additionally, our website uses Google Analytics. If You would like to opt-out of having Your data used by Google Analytics, please use the Google Analytics opt-out, available here.

Our website or app may provide links to third party websites for Your convenience. Please be aware that myPOS exercises no control over such other websites and is not responsible for their privacy practices.

4. California Residents: Your Rights

California residents (“You” or “Your” for purposes of this section of the Notice) have specific rights regarding personal information under the California Consumer Privacy Act (“CCPA”). Please note that the CCPA does not apply to certain categories of personal information. For example, the CCPA does not apply to personal information that is regulated by the Gramm-Leach-Bliley Act or personal information that is collected in a business-to-business context. While the disclosures we make in this CCPA section of the Notice may account for those types of exempted data, we may decline to act on any requests to exercise CCPA rights with respect to such data.

Additionally, to the extent myPOS maintains personal information in the capacity of a “service provider” rather than as a “business” (as those terms are defined under the CCPA), we may direct You to address any CCPA rights requests to the “business” that provided us Your personal information.

Right to Know and Data Portability

You have the right to request that myPOS disclose certain information to You about our collection, use, disclosure and sale of Your personal information over the past 12 months. Once we receive and confirm Your request, to the extent You have requested them, we will disclose to You:

  • The categories of personal information we collected about You;
  • The categories of sources from which Your personal information was collected;
  • Our business or commercial purpose for collecting Your personal information;
  • The categories of third parties with whom we have shared Your personal information, if any;
  • The specific pieces of personal information we have collected about You (also called a data portability request); and
  • If we sold or disclosed Your personal information for a business purpose, two separate lists disclosing:
    • Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained; and
    • Sales, identifying the personal information categories that each category of recipient purchased. myPOS does not “sell“ personal information as that term is defined in the CCPA.

Right to Delete

You have the right to request that myPOS delete any of the personal information we have collected and maintain about You, subject to certain exceptions. Once we receive and confirm Your request, we will either delete, de-identify, or aggregate Your personal information, unless not doing so is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, take actions reasonably anticipated within the context of our business relationship with You, or otherwise perform our contract with You;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Debug products to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, if You have previously provided informed consent;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on Your relationship with us;
  • Comply with a legal obligation; or
  • Make other internal and lawful uses of that information that are compatible with the context in which You provided it.

Exercising Your Rights to Know and Delete

Only You, or someone legally authorized to act on Your behalf (i.e., Your authorized agent), may make a request related to Your personal information. myPOS may require an agent to provide verification that they are acting on Your behalf when they submit a request related to Your personal information.

All requests to know or delete (whether made by You or an authorized agent) must (1) provide sufficient information for us to reasonably verify You by providing two to three pieces of personal information which we will match with personal information we maintain in our records, and (2) describe Your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Non-Discrimination

myPOS will not discriminate against You for exercising any of Your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny You services;
  • Charge You different prices or rates for services, including through granting discounts or other benefits, or imposing penalties;
  • Provide You a different level or quality of services; or
  • Suggest that You may receive a different price or rate for services or a different level or quality of services.

5. We Limit Use of Your Personal Data to:

  • Providing, maintaining and improving our Services;
  • Verifying Your identity, where applicable;
  • Communicating with You about new and existing Services;
  • Protecting the legal rights, property and safety of our Services and users.

6. We Collect and Use Data

Data We Collect:

Your name, email address, phone number, birth date, government-issued identification number, where necessary, payment card and bank information, if applicable, as well as other information You may be asked to provide when signing-up for an account, providing identity verification or engaging in a transaction.

Other Data:

  • Transaction Data: when, where and how a transaction takes place including, but not limited to, the devices and payment methods used;
  • Device Data: hardware model, operating system, unique device identifiers, mobile network data as well as other data generated by a device's interaction with our Services;
  • Location Data: to prevent fraudulent use of our Services;
  • User Data: browser data, Internet Protocol ("IP") addresses and other data describing user engagement;
  • Cookies: small data files we may store on Your computer or mobile device memory to help us manage Your engagement with our Services, including gathering aggregated data about engagement;
  • Beacons: small electronic images we may use in our Services and emails to deliver cookies and measure user engagement.
  • Information to Enhance Your Experience: other data such as a profile picture that may enhance Your experience.

  • We also check that You are using our Services legally and are eligible for the Services You want to use. We protect the Services from fraudsters who may put You and Your money at risk. To do this, we may collect data about You from companies that help us verify Your identity, if applicable, prevent fraud or assess risk.
  • We collect (and/or have collected during at least the 12-month period preceding the effective date of this Policy) information about You from the following categories of sources:
    • You directly, when You submit information to us or allow us to access information,
    • Your devices and how You interact with our Services, and
    • Other sources, including:
      • Identity Verification, if applicable. Information from third-party identity verification services and publicly available sources, including Your government-issued identification number.
      • Eligibility, Compliance, and Fraud. Information about You from third parties for any investigation, eligibility, identity or account verification process, fraud detection process, or collection procedure, or as may otherwise be required by applicable law. This may include, without limitation, the receipt and exchange of account or transaction-related information with any consumer reporting agency.

We may share aggregated and anonymized information that does not specifically identify You or any individual user of our Services.

7. We Share Personal Data Under Controlled Circumstances:

  • With third parties who may access data about You to provide You with the Services;
  • With third parties who may access data about You to perform functions on our behalf;
  • With financial institutions, processors, payment card associations and other entities that are involved in the payment process;
  • With government and law enforcement where reasonably necessary to comply with applicable law, regulation, legal process, or governmental request;
  • With others where reasonably necessary to protect the security or integrity of our Services or user safety;
  • In connection with, or during the negotiation of, any merger, sale of company stock or assets, financing, acquisition, divestiture or dissolution of all or a portion of our business;
  • With Your consent.

8. Security

We take reasonable measures, including administrative, technical and physical safeguards to help protect Your personal data from loss, theft, misuse, unauthorized access, disclosure, alteration and destruction.

We maintain strict security standards and procedures with a view to preventing unauthorized access to Your data by anyone, including our staff. We use leading technologies such as (but not limited to) data encryption, firewalls and server authentication to protect the security of Your data.

9. Protection of Certain Personally Identifying Information

myPOS discloses potentially personally identifying and personally identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on myPOS’s behalf or to provide services available at myPOS’s websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of Your home country; by using myPOS’s Services, You consent to the transfer of such information to them. myPOS will not rent or sell potentially personally identifying and personally identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, myPOS discloses potentially personally identifying and personally identifying information only in response to a subpoena, court order or other governmental request, or when myPOS believes in good faith that disclosure is reasonably necessary to protect the property or rights of myPOS, third parties or the public at large.

If You are a registered user of myPOS Services (i.e. Customer) and have supplied Your email address, myPOS may occasionally send You emails to inform You of new features, solicit Your feedback, or just keep You up to date with what’s going on with myPOS and our products. We primarily use our various product blogs to communicate this type of information, so we expect to keep this type of emails to a minimum. If You send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to Your request or to help us support other users. myPOS takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally identifying and personally identifying information.

The security of Your personal information is important to us. We utilize physical, electronic and procedural security measures to protect against loss, misuse, and alteration of information under our control. We offer industry-standard practices and security measures to safeguard and secure the personal information we collect. However, some of the applications or networks that You use may not be completely secure, thus we cannot guarantee absolute security.

10. Choices:

  • Personal Data: You can change or correct data about Yourself through Your myPOS account at any time or by emailing us at support@myPOS.com. You can also email us if You wish to deactivate Your account. We may retain data about You for a period consistent with applicable law.
  • Location Data, if applicable: Our mobile applications may require location data. If You do not grant us access to this data then You may not be able to use our Services. If You grant access to location data but later revoke this access Your mobile device may no longer be able to use our Services. You may also uninstall our Services to stop collection of location data.
  • Cookies: You can set Your browser to reject cookies but our Services may not function properly in this setting.
  • Marketing: You can opt-out of email or text messages by following instructions in these messages. If You opt-out we may still send You messages regarding transactions and services related to our ongoing business relationship.
  • Notifications: Our Services may ask You for permission to send notifications to Your device. Our services will still work if You do not grant us permission to send You notifications.
  • Website Tracking: Certain websites You visit may provide options regarding advertisements You receive. For more information or to opt out of certain online behavioral advertising, please visit http://www.aboutads.info.
  • Do Not Track: Some browsers support a “Do Not Track” feature, which is intended to be a signal to websites that You do not wish to be tracked across different websites You visit. Our Services do not currently change the way they operate based upon detection of a Do Not Track or similar signal.

11. Third Parties

The Services may present You information relating to third party products or services as well as provide You general tips, recommendations and educational material.

When using our Services, You may have the option to provide Us with information from third parties, such as Facebook, Twitter, Google, and LinkedIn. We may also acquire information about You from third parties in order to verify Your identity, process Your transactions, detect and prevent fraud, or other similar purposes.

We are not responsible for the privacy practices of any third parties or the content of sites that are linked from our Services. We strongly encourage You to read the applicable privacy policies and terms and conditions of such parties or websites.

12. Third-Party Analytics Services

We and our third-party service providers may sometimes use technologies to engage in data analytics, auditing, measurement, research, reporting, and debugging on our Services and to measure interactions with our services, such as tracking referral credits. 13. Third-Party Data

The Services contain hyperlinks to other websites or locations that we do not control and are operated and controlled by third parties (“Third-Party Websites”). Our Privacy Policy does not apply to these Third-Party Websites and we make no representations regarding the policies or business practices of any such Third-Party Websites.

14. Cookies and Tracking Technologies:

We and our partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and gather information about our user base, such as location information based on IP addresses. You can control the use of cookies at the individual browser level.

A cookie is a string of information that a website stores on a visitor’s computer and that the visitor’s browser provides to the website each time the visitor returns. Cookies are small text files that are placed on Your computer by websites and services that You visit or access. They are widely used to make websites and services work and function with greater efficiency, and to provide information about our users’ experience during use of, or interaction with, our websites, and Services. Some cookies last only for the duration of Your web session and expire when You exit Your browser; other cookies may last for longer than Your web session, including after You exit Your browser, for example by remembering You when You return to our website. The information below explains the cookies that we and our third-party partners use and why.

Functional Cookie for Preferences and Settings: These cookies are used to record a user’s choice and settings that enable our websites and Services to operate correctly or that maintain Your preferences over time and may be stored on Your device.

Functional Cookie for Sign in and Authentication: When You sign into a website or Service using Your myPOS account, we may store a unique ID number, and the time You signed in, in an encrypted cookie on Your device. This cookie allows You to move from page to page within the website without having to sign in again on each page. You can also save Your sign-in information, so You do not have to sign in each time You return to the site.

myPOS visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using myPOS’s websites, with the drawback that certain features of myPOS’s Services may not function properly without the aid of cookies.

Analytics Cookie: To provide our products and improve Your user experience on our websites and with our Services, we use cookies and other identifiers to gather usage and performance data. For example, we use cookies to count the number of unique visitors to a web page or service or to our blog and to develop other statistics about the operations of our Services. This may include cookies from us and from third-party providers. We use the information to compile reports and to help us improve our websites and Services.

15. How to Control Cookies

Most web browsers automatically accept cookies but provide controls that allow You to block or delete them. For example, in most modern browsers, You can block or delete cookies by clicking Settings > myPOS > Cookies. Certain features of our Services may depend on cookies. Please be aware that if You choose to block cookies, You may not be able to sign in or use those features, and preferences that are dependent on cookies may be lost. If You choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, will be deleted and may need to be recreated.

16. Business Transfers

If myPOS, or substantially all of its assets, are acquired, or in the event that myPOS goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of myPOS may continue to use Your personal information as set forth in this Policy.

17. Ads

Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize Your computer each time they send You an online advertisement to compile information about You or others who use Your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to You. This Policy covers the use of cookies by myPOS and does not cover the use of cookies by any advertisers.

18. Privacy Policy Changes

myPOS, in its sole discretion may change its Privacy & Security Policy from time to time. If we make changes, we will notify You by posting the updated Policy and revising the “Date Last Updated” above. myPOS encourages You to frequently check this page for any changes to this Policy. Changes take effect immediately upon posting. In some cases, we may provide You with additional notice (such as by adding a statement to the homepages of our website or mobile application or by sending You an email notification). We encourage You to review the Privacy Policy whenever You interact with Us to stay informed about our information practices and the ways You can help protect Your privacy. Your continued use of the Services after any change in this Policy will constitute Your acceptance of such changes. If You disagree with these changes, You may cancel Your account at any time. If You keep using our Services, You consent to any amendment of this Policy.

19. Opting Out of This Policy

If You no longer wish to use our Services and would like to delete or deactivate Your account, please contact us at support@myPOS.com.
