| “Game” means a promotional campaign, that is managed by the Organizer, for the Game Period, in accordance with the present General Terms | “Spel” betekent een promotiecampagne, die wordt beheerd door de Organisator, voor de Spelperiode, in overeenstemming met deze Algemene Voorwaarden. |
| “Participant” means a client, actively using the myPOS acquiring service that is fully verified and in good standing with the financial institution, providing the acquiring service. In addition, the Participant must conform to all of the below: | “Deelnemer” betekent een klant die actief gebruik maakt van de myPOS betaaldiensten en die volledig geverifieerd is en een goede reputatie heeft bij de financiële instelling die de betaaldiensten verleent. Daarnaast moet de Deelnemer aan alle onderstaande voorwaarden voldoen: |
| 1. The Participant must have accepted at least one American Express card payment via his/her myPOS device or online payments acceptance tool. | 1. De Deelnemer moet minstens één betaling met een American Express-kaart hebben geaccepteerd via zijn/haar myPOS-apparaat of diensten voor het accepteren van online betalingen. |
| 2. The Participant must not be a member or shareholder or works under an employment relationship or on the basis of another contract with the Organizer or any Related Party within the meaning given in the LPOS, or is engaged in an activity related to the realization, provision, and administration of the campaign. In the event of such incompatibility with this requirement, the Organizer shall cease such person’s right to participate until the incompatibility of the Participant is proven non – existent | 2. De Deelnemer mag geen lid of aandeelhouder zijn van de Organisator of een gelieerde partij, zoals gedefinieerd in de LPOS, noch werkzaam zijn in dienstverband of op basis van een ander contract met de Organisator. De Deelnemer mag ook niet betrokken zijn bij activiteiten die verband houden met de realisatie, verstrekking en administratie van de campagne. Indien deze voorwaarde niet wordt nageleefd, behouden de Organisatoren zich het recht voor de deelname van de betreffende persoon te beëindigen, tenzij kan worden aangetoond dat de incompatibiliteit niet langer van toepassing is. |
| 3. The Participant must be established in the Netherlands. | 3. De Deelnemer moet in Nederland gevestigd zijn. |
| “Game Period” means the time frame, during which the Participants can participate in the Game in accordance with the current General Terms and Conditions. | “Spelperiode” betekent het tijdsbestek waarbinnen de Deelnemers aan het Spel kunnen deelnemen in overeenstemming met de huidige Algemene Voorwaarden. |
| The current General Terms and Conditions establish the rules regarding the promotional campaign “Win with American Express” in the Netherlands. The Game is carried out with the support of American Express. | De huidige Algemene Voorwaarden bepalen de regels voor de promotiecampagne “Win een prijs met American Express” in Nederland. Het Spel wordt georganiseerd met ondersteuning van American Express. |
| The General Terms and Conditions are prepared in accordance with the requirements of the Netherlands legislation and are published on the myPOS website. | De Algemene Voorwaarden zijn opgesteld in overeenstemming met de Nederlandse wetgeving en zijn gepubliceerd op de website van myPOS. |
| By participating in the Game the Participants are bound by the present General Terms and agree to comply with the latter. | Door deel te nemen aan het Spel zijn de Deelnemers gebonden aan deze Algemene Voorwaarden en stemmen zij ermee in deze na te leven. |

| The Organizer of the campaign is myPOS Technologies EAD, registered in the Commercial Register, with UIC 205050564, registered and head office: Bulgaria, Varna, Business Park Varna B1 (“Organizer”). | De organisator van de campagne is myPOS Technologies EAD, geregistreerd in het handelsregister onder UIC 205050564, met statutaire zetel en hoofdkantoor gevestigd in Bulgarije, Varna, Business Park Varna B1 (“Organisator”). |

| Each person/entity, which adheres to the definition of a “Participant” and is not barred for any other legal reason from participation in this Game, is able to participate in the latter. | Elke persoon/entiteit die voldoet aan de definitie van een “Deelnemer” en die niet om een andere wettelijke reden is uitgesloten van deelname aan dit Spel, kan aan dit Spel deelnemen. |

| During the Game period, each Participant that has accepted at least one American Express card payment via his/her myPOS POS device(s) or online payment acceptance tools, is automatically enrolled in a sweepstake for the possibility to win 1 (one) Apple Watch Series 8 GPS 45mm. Each Participant will be allowed only one valid entry into the sweepstake. | Gedurende de Spelperiode wordt elke Deelnemer die minimaal één betaling heeft geaccepteerd met een American Express kaart via hun myPOS-betaalautomaat of één van de diensten voor het accepteren van online betalingen, automatisch ingeschreven in een loterij waarbij ze kans maken op het winnen van 1 (één) Apple Watch Series 8 GPS 45mm. Elke Deelnemer ontvangt slechts één geldige deelname aan de loterij. |
| Any Merchant, that does not wish to participate in the Game can send us their preference to marketing@mypos.com. | Ondernemers die niet aan het Spel wensen deel te nemen, kunnen dit aan ons laten weten door een e-mail te sturen naar marketing@mypos.com. |
| PRIZES AND WINNERS | PRIJZEN EN WINNAARS |
| The Participants shall have the chance to win 1 (one) of 10 (ten) smart watches Apple Watch Series 8 GPS 45mm. | De Deelnemers maken kans op 1 (één) van 10 (tien) Apple Watch Series 8 GPS 45mm smartwatches. |
| Within a period of 2 (two) weeks after the end of the Campaign, the Organizer shall pick the names of ten Participants who shall win a prize, using an automatic software RANDOM NAME PICKER (https://commentpicker.com/random-name-picker.php). | Binnen een periode van 2 (twee) weken na afloop van de campagne selecteert de Organisator met behulp van geautomatiseerde software genaamd RANDOM NAME PICKER (https://commentpicker.com/random-name-picker.php) de namen van tien Deelnemers die een prijs winnen. |
| The Organizer shall also pick ten Participants as reserves, in case the primary Winner does not come forward to receive its prize. | De Organisator selecteert ook tien Deelnemers als reserve, voor het geval de winnaar zich niet meldt om zijn/haar prijs in ontvangst te nemen. |
| The Participants picked as Winners shall be notified via their contact data, submitted during the registration process for the myPOS service no later than 1 (one) week after the pick. | Deelnemers die als winnaars worden gekozen, worden uiterlijk binnen 1 (één) week na de loting op de hoogte gesteld via de contactgegevens die zij hebben verstrekt tijdens het registratieproces voor de myPOS betaaldiensten. |
| The Winners shall receive their prizes within two weeks of the confirmation set out in pt. 6.1., via courier service on their address registered for the myPOS Service. | De Winnaars zullen hun prijzen binnen twee weken na de bevestiging, zoals vermeld in punt 6.1, ontvangen via een koeriersdienst op het adres dat geregistreerd staat voor de myPOS betaaldiensten. |

| The Participant shall have 1 (one) week from the notification to him/her for the winning of the prize to confirm his/her wish to receive it and to provide an address to which he/she wants it shipped. | De Deelnemer heeft 1 (één) week de tijd, vanaf het moment dat hem/haar is medegedeeld dat hij/zij de prijs heeft gewonnen, om te bevestigen dat hij/zij de prijs wil ontvangen en om een adres op te geven waar hij/zij de prijs naar toe gestuurd wil hebben. |

| The new Winner is subject to the rules in art. 6.2 – in case it’s not possible to contact him/her in a period of 1 (one) week, the prize shall be offered to the next Participant, picked as a reserve. If in the abomination term, the Organizer does not succeed in contacting any of the picked Participants, or in the event that they refuse to accept the offered Prize, the Organizer shall be released from his obligation to giveaway the prize. | De nieuwe winnaar is onderworpen aan de regels zoals vermeld in artikel 6.2. | The Organizer shall process the personal data in accordance with Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“General Data Protection Regulation”), as well as any applicable national legislation. Detailed information on the purposes and legal basis for the processing of personal data; the categories of recipients of personal data; the period for which the personal data shall be stored; the rights of data subjects in relation to the processing of their personal data by the Organizer as well as information on how they can be exercised; contact details of the Data Protection Officer, and any other information which is required to be provided in accordance with the General Data Protection Regulation to the data subjects are contained in the Privacy Notice for myPOS Promotional Campaigns | De Organisator verwerkt persoonsgegevens in overeenstemming met Verordening (EU) 2016/679 van het Europees Parlement en de Raad van 27 april 2016, ook bekend als de Algemene Verordening Gegevensbescherming (AVG), evenals alle toepasselijke nationale wetgeving. | The current General Terms and Conditions shall be made public and available throughout the Game Period on the Organizer’s website at myPOS.com. | De huidige Algemene Voorwaarden worden openbaar gemaakt en zijn gedurende de gehele Spelperiode beschikbaar op de website van de Organisator op myPOS.com. |
| LOSS OF RIGHT TO PARTICIPATE IN THE GAME | VERLIES VAN HET RECHT OP DEELNAME AAN HET SPEL |
| Any Participant who fails to meet any of the requirements, expressed in the definition of “Participant”, shall lose the right to participate in this Game. | Elke Deelnemer die niet voldoet aan een van de vereisten, zoals vermeld in de definitie van “Deelnemer”, verliest het recht op deelname aan dit Spel. |
| TERMINATION OF THE GAME | BEËINDIGING VAN HET SPEL |
| The Organizer has the irrevocable right to terminate the Game at any time, by declaring this in accordance with Section 8 Publicity, in the event of circumstances beyond his control that hinder the Game’s further performance and cannot be eliminated by the Organizer. | De Organisator behoudt het onherroepelijke recht om het spel op elk moment te beëindigen door dit overeenkomstig Sectie 8 “Publiciteit” bekend te maken, in het geval van overmacht die de verdere uitvoering van het spel belemmert en niet door de Organisator kan worden verholpen. |
| The Organizer has the irrevocable right to terminate the Game at any time without notice to the Participants if he finds abuse or gross violation of the rules, in case of force majeure or for other objective reasons, including but not limited to material losses, an order of the competent state authorities for the suspension of the Game, and others. In the event of misuse, negligence, or violation of the General Terms by a Participant, the Organizer has the right to disqualify him | De Organisator behoudt het onherroepelijke recht om het spel op elk moment zonder kennisgeving aan de Deelnemers te beëindigen in geval van misbruik of ernstige overtreding van de regels, overmacht of andere objectieve redenen, waaronder maar niet beperkt tot materiële verliezen, een besluit van de bevoegde overheidsinstanties tot opschorting van het spel, etc. Indien een Deelnemer misbruik maakt, nalatig handelt of de Algemene Voorwaarden overtreedt, behoudt de Organisator het recht om hem/haar te diskwalificeren. |
| FINAL PROVISIONS | SLOTBEPALINGEN |
| The Organizer reserves the right, at his sole discretion, to amend and supplement the terms and conditions of this Game, and any changes shall be made public and available to all participants and users in accordance with Section 8 Publicity. | De Organisator behoudt zich het recht voor om, naar eigen inzicht, de voorwaarden van dit spel te wijzigen en aan te vullen. Alle wijzigingen zullen openbaar worden gemaakt en beschikbaar worden gesteld aan alle Deelnemers en gebruikers in overeenstemming met Sectie 8 “Publiciteit”. |
| Any change in the terms of the Game Period shall be duly published on the official website mypos.com | Elke wijziging in de voorwaarden van de Spelperiode zal tijdig worden gepubliceerd op de officiële website mypos.com. |
| For the cases not settled by the current General Terms and Conditions the provisions of Netherlands law shall apply. Any dispute, contradiction, or claim arising out of or relating to the performance, interpretation, application, or termination of the General Terms and Conditions shall be governed by the parties through mutual concessions. If the parties fail to settle their relations out of court, the relevant Bulgarian court is competent to resolve the dispute, in accordance with the Netherlands legislation. | In gevallen waarin deze Algemene Voorwaarden niet zijn voorzien, is de Nederlandse wet van toepassing. Alle geschillen, tegenstrijdigheden of vorderingen die voortvloeien uit of verband houden met de uitvoering, interpretatie, toepassing of beëindiging van deze Algemene Voorwaarden zullen door de partijen worden opgelost door middel van onderling overleg. Indien de partijen er niet in slagen om hun geschillen buitengerechtelijk te regelen, is de bevoegde Bulgaarse rechtbank gerechtigd om het geschil te beslechten, met inachtneming van de Nederlandse wetgeving. |
